Petition by the plaintiff Green Bay & Western Railroad Company (hereinafter referred to as the 'railroad company') against
the Public Service Commission of Wisconsin instituted pursuant to the Wisconsin Uniform Administrative Procedure Act, ch.
227, Stats., to review an order dated August 28, 1953, of said commission authorizing the construction of a new highway crossing
at grade in the city of Green Bay, pursuant to the application therefor of the State Highway Commission. As part of the improvement of U. S. Highway 41, the State Highway Commission proposes to create a bypass route in the western
portion of the city of Green Bay for the purpose of relieving congested traffic in downtown Green Bay. Such bypass route would
proceed down Military avenue and across the tracks of the railroad company. This involves the opening up of such street across
the 66 foot right-of-way of the railroad company which is owned by it in fee simple. Heretofore Military avenue has ended
at such railroad right-of-way. Pursuant to such plans for construction of this bypass route the State Highway Commission filed
an application with the Public Service Commission under sec. 195.29, Stats., for the establishment of a grade crossing by
extending Military avenue, over which U. S. Highway 41 is to be located, across said railroad right-of-way. Hearings were
held on said application upon notice given to the railroad company, and under date of August 28, 1953, the Public Service
Commission issued its order granting the application to establish such new grade crossing.
